My friend 485 has been filed on 12th - to nebraska service center, but he mistakenly sent his ead & ap on 15th to Texus Service Center in Dullas.(Did not receive the receipt notice for 485)
Please let me know his options!
1) Do they reject his applications in TSC?.
2) If he file another set in Nebraska Service Center is ok?

There is a provision for extending B2 visa. If they dont allow, they wouldnt have it in the first place. I understand getting Immigration benefit is a privilege and not a right! The question is how to balance our needs without overreaching it!

Good Luck to all of you, but nowadays if a person is below the age of 60, getting a Visitors Visa is difficult, but there are exceptional cases too.but no guarantee that they will issue a Visa. Show bank account, or real estate in their names, And also appoint letter may help, but there is no guarantee, only Visitor's visas issued for youngsters are Celebrities, Business persons, diplomats and if you are able to convince US consulate that you will come back for sure. (with proving documents!) otherwise it is difficult to my knowledge.

Both Shaktisagar and Greyhair make very valid points. Which side wins the argument well only time will tell. Nothing works the way it ideally should. The world is evolving and this recession and all this policies are all part of the evolution. People have started rethinking the value of having money versus true peace/hapiness slowly. In the US the disparity was partly hidden by the "plastic". Everybody was given a plastic and everybody could buy and live the "dream". Well that has just about ended to some extent. The problem is that, it is just about begining in Indian/china/brazil and russia.
What brings real peace/hapiness? Once 3rd world citizens (like Indians) get over the issue of "am I better than my neighbour?" India will progress towards its real goal very fast. The real goal being true peace and hapiness rather than the pseudo/fancy/fantasy/unreal/materialistic world that is propagated by the media.
If only we all had easy access to our inner ability for tremendous patience to tide over this process of evolution.......But it lies beyond our reach while we lie rolling in the misery created by our thoughts and desires.........

short answer Nope
a) because immigration is not high on Obama's agenda.
b) the economic downturn will be used by the the anti's to thwart any measure to help us
c) We are still very low on everyone's plate, democrats will want to get the illegals and all will use us as a pawn.
d) The trend is that the right will become hard right and left will become hard left...wait and watch.
the guys who will post bad comments, please remember that i had posted something similar when the democrats got majority and we have multiple threads singing the lords praise and showering flowers. It will be politics as usual.
We need lots of active members to make ONE strong case and keep hammering away at the lawmakers, instead we get a daily dose of self motivated threads which divide the already small group into smaller groups ((petitions, cases, class actions, EB3 Vs EB2, masters Vs 'grand'Masters etc:rolleyes:) .

I think thousand is over exagerated. Most people have filled their application at NSC.
I also have a consiparacy theory now. The dates porbably have moved out because of TSC as they did not have enough cases to process.
Not only July 2nd but probably 1000s of 2004 PDs with July 2 as RD are waiting......Its great to see 2006 approvals - at least USCIS is working......but FIFO does not exist in their dictionary.....Its probably LIFO....

both H1 and H4 extension are filed together regularly.
However, the need now arises to upgrade both to premium processing.
Attorney claims I can only get H1 under premium and if processing center wants they will process H4 under premium as well.
But I cannot find this memo that speaks of premium processing being available for I-539 applications as well. It happened sometime last year.

My husband and I are July 2 Neb transfer to TX and we got approval email on 8/1. PD is 2005 Dec.
Does your receipt number starts with SRC#? I don't see any non SRC# approvals so far at TSC. Please share your PD also.

If my 140 is still in process,can i file another perm labour and can i use my old labour dates.

Priority dates cannot be ported unless I-140 is approved. Unfortunately, in this case it looks like you will lose your original PD if they deny/refuse to accept your I-140 application.

you said u file ITIN for tax needs - why did u apply for job dude. ITIN doesn't get u a job. H4 can't work in USA...as simple as that. Hire a good lawyer and tax consultant.

When the time will come for my employer to process my GC, what consequences will my spouse's unauthorised employment have on Her ability to receive a Greencard? What are the ways to rectify the situation? Appeals? Special provisions/clauses? Cost?

My H1B was filed with job title "RF Engineer" which comes under "Electrical Engineering" in 2004. My first 3-year term on H1 expires this year end and employer needs to file for renewal for next 3-year term.
My LC as well as 140 were applied and are approved for the position of "Electronics Engineer" which is my current position.
Essentially Electronics Engineer position is a superset of RF Engineer/Electrical Engineer positions, job duties are pretty much the same.
So now when I apply for my H1B renewal/extension does employer have to write the current position (Electronics engr) or the position on which H1B was filed first (RF engr)?
Any inputs appeciated...

2yrs ago, my friend did H1 extension -premium processing and he filed his wife H4 extension along with his extension application. so USCIS approved both within 15 days because both are filed together.
if filed separately, i dont think you can have premium processing for H4. check with your immigration attroney as laws/procedures changes often.
